Terms of sale

1. Seller’s identity

These Terms and Conditions of Sale are issued by Jade FIEGEL, a sole trader operating under the French micro-enterprise scheme under the trading name Tygani, SIREN 984 768 655, SIRET 984 768 655 00016, registered with the French National Business Register in Évreux. Contact: contact@tygani.fr.

2. Purpose and scope

These terms govern sales concluded with consumers through the Tygani shop. Placing an order constitutes acceptance of the terms applicable when the order is confirmed.

3. Products

Tygani mainly sells antique, vintage or second-hand objects, furniture, artworks, books, clothing and other items. Most are unique pieces. The essential characteristics, dimensions, materials, estimated period, condition and known defects are stated on each product page and shown in the photographs. Minor colour differences caused by screens and the described signs of use do not constitute a lack of conformity.

4. Prices

Prices are stated in euros. VAT is not applicable under Article 293 B of the French General Tax Code. Collection by appointment is free. Where delivery is available, the applicable charges are shown before payment according to the item, destination and available transport method. For furniture and bulky items, please contact Tygani before ordering so that transport arrangements and costs can be considered. Tygani may change its prices at any time, without affecting orders already confirmed.

5. Orders and availability

Before confirming an order carrying an obligation to pay, the customer checks the contents of the basket, their contact details and the selected delivery or collection method. The sale is concluded once the order is confirmed and payment approved. If an item is exceptionally unavailable, in particular because a unique piece has been sold simultaneously on another platform, the customer will be informed and refunded without undue delay.

6. Payment

Payment is made using the options offered at checkout. The order may be suspended or cancelled if payment is refused, fraud is suspected or information provided is clearly incorrect.

7. Delivery and collection by appointment

Delivery is available for eligible items, according to the options shown during checkout. Furniture and bulky items require prior discussion with Tygani to determine transport arrangements and costs. Free collection by appointment in Normandy is also available. After payment is confirmed, Tygani contacts the customer to agree the practical arrangements and precise location. The customer must provide a suitable vehicle, protective materials and, where necessary, adequate help with handling.

The risk of loss or damage passes to the consumer when they take physical possession of the goods, subject to the applicable statutory rules.

8. Right of withdrawal

The consumer has 14 days from taking possession of the goods to notify their withdrawal by emailing contact@tygani.fr, followed by 14 days in which to return the goods. Return arrangements, costs and refund conditions are detailed in the Return and Refund Policy. The right of withdrawal is exercised in accordance with Articles L.221-18 and following of the French Consumer Code.

9. Statutory guarantees

The consumer benefits from the statutory guarantee of conformity provided by Articles L.217-3 and following of the French Consumer Code and the guarantee against hidden defects provided by Articles 1641 and following of the French Civil Code. These guarantees also apply to second-hand goods under the conditions laid down by law.

10. Complaints

Complaints must be sent to contact@tygani.fr with the order number, a precise description and, where necessary, photographs. Tygani will seek an amicable solution before any further action.

11. Consumer mediation — pending completion

A mediator is currently being appointed. This section will be completed once the mandatory agreement has been signed with a mediator listed by the French Consumer Mediation Evaluation and Control Commission. The mediator’s contact details will be published here once the agreement has been finalised.

12. Personal data

Data processing is described in the Privacy Policy available on the shop.

13. Governing law and disputes

These terms are governed by French law. Consumers retain the benefit of any mandatory provisions of their country of residence. If no amicable resolution is reached, the competent courts will be determined in accordance with the applicable legal rules.
